Terms and Conditions

  1. General Terms and Conditions

1.1 The following administrative terms apply to contracts arranged by Iksam, acting as supplier of passenger services between the departure points and destinations specified at the time these services are booked and paid for(“service”, “services”). References to “Customer”, “you”and“your” in these administrative terms and conditions mean all passengers listed in the written confirmation (including anyone who is substituted or added at a later date). “We”, “us” and “our” means Iksam.

1.2 The users of the service can be people aged 18 and over only, holders of valid identity documents – passport, identity card and a valid credit card. People under 18 years can use the service with an accompanying adult of full age of 18.

1.3 By arranging the services through us, you agree to be bound by these terms and conditions (as they may be modified and posted on our website from time to time) as well as other information contained on the website, app, email or any other form of electronic or written communication with you.

  1. Booking, Prices and payment method

2.1 Bookings may be made online on the www.iksam.com, by email travel@iksam.com or phone +359 89 566 3731, +359 88 911 2461. When two or more people are included in the same booking, the person making the booking (“you”) shall be deemed to have done so on behalf of both or all members of the party and he or she accepts these terms and conditions on behalf of himse. You must follow the process for making the booking and paying for the services (either at the time of booking or immediately prior to the use by you of the services).

The correspondence between Iksam and the Customer shall be organized as follows:

– You make an order and receive an e-mail confirming successful reservation.

– Iksam receives your booking by mail, processes it, and sends you a confirmation by email provided in the order form

2.2 Iksam do not guarantee the implementation of the booking that is made less than 24 hours before the transfer, if you have not received confirmation from us.

2.3 Full payment is required either

(i) online at the time of booking; or

(ii)  in cash to the driver in the end of transfer.

2.4 The prices for services are published on the web page www.iksam.com and are effective as of the time of Customer’s order. The service cost shall be confirmed as part of the order accepting procedure by Iksam. If the price has not been properly registered in the course of the order the Customer shall be additionally notified, and the latter may accept or cancel the order under the correct conditions. In case of order cancellation Iksam shall return the prepaid booking deposit in full but shall not pay an extra compensation to Customer.

2.5 The services prices are listed in Euros payable in the relevant currency or in Bulgarian Leva at the daily rates of the Bulgarian Central Bank (BNB).

2.6 The prices is per vehicle and includes: hire of transportation vehicle, driver hire, fuel expenses, greet and meet service at the meeting point, passenger seat insurance, free child seats, prepaid road taxes, parking fees. The price doesn’t include entry tickets touristic, historical, etc; food and drinks; personal expenses.

  1. Meeting and customer transportation

3.1 The driver meets the customer at the place and the time specified in the reservation voucher. If the Customer is not able to find the driver or Iksam representative at the meeting point he shall immediately call the phone numbers provided in the email with confirmation. If such a call is not registered in the Iksam office, the order shall be deemed cancelled due to Customer’s failure to appear (NO SHOW). In this case the Customer is not entitled to compensation and shall pay Iksam or its partner the full amount of the order.

3.2 The driver will wait for you 1 hour after landing, after 1 hour waiting the order shall be deemed cancelled due to Customer’s failure to appear (NO SHOW). In this case the Customer is not entitled to compensation and shall pay Iksam or its partner the full amount of the order. The exception is if you contact our office at phone provided in the email with confirmation and warned that delayed for any reason (for example: loss of baggage).

3.3 Iksam and its partners shall do everything possible to meet the Customer at the place and the time stated in the reservation voucher, but shall bear no responsibility and shall pay no compensation to the Customer for losses suffered (for example: missed flight, train, bus), if Iksam fails to provide the service on time, due to circumstances beyond its control (for example: traffic jams, traffic accidents, road construction, etc).

3.4 In some destinations your transfer/shuttle pick up and drop off may not be supplied to your hotel door and you may be dropped off or picked up at a central point within reasonable walking distance from your final destination.

3.5 The Iksam, its drivers and appointed agents, reserve the right to refuse to carry any person who is, or appears to be, under the influence of alcohol or illegal drugs and/or whose behaviour is considered to pose a threat to the driver, the vehicle or the other passengers. No refunds will be made in those circumstances.

3.6 The passenger seat insurance doesn’t cover loss or theft of Customers personal belongings as well lacks and damages to the interior of the transportation vehicle.

  1. Child Seats and Child Pricing

4.1 Under the Bulgarian legislation, children aged less than 1 year, weighting less than 13 kg must travel in the rented car in rear-facing baby seats. Children older than 1 year and weighting over 8 kg must use a child seat, and children shorter than 1.50 m in height and weighting more than 17 kg should use seat belts and a booster seat.

4.2 Iksam offers free standard child seats and booster seats; Customer can use their own ones to ensure a maximum safety and comfort of the travelling children.

4.3 It is Customer‘s responsibility to order the number and type of child seats required for his service in the booking form. Iksam and its partners bear no responsibility for service delays or passengers travelling in the transportation vehicle without the proper child seats, due Customer not complying with this condition.

4.4 Prices for services is per vehicle, not per person. Regardless of the number of adults and children, the price for the vehicle does not change, unless it is additionally persuaded.

  1. Bookings for disabled passengers

5.1 We and our suppliers are not a specialist disabled transportation company, but will use reasonable endeavours to cater for any requirements you may have. If you or any member of your party has any medical condition or disability which may affect your ability to use our standard services and/or if available wheelchair adaptable vehicles, please provide us with your requirements via our website or app before you confirm your booking so that we may advise you of the suitability of your chosen arrangements, so that we may ensure that the correct vehicle is booked to meet with requirements where available.

5.2 The customer is responsible for additional fees that may arise when ordering a specialized vehicle.

  1. Baggage

6.1 Our suppliers will use reasonable endeavours to accommodate all baggage carried by your party. Each passenger named on the booking is entitled to have carried with him on the relevant transfers up to two items of baggage, i.e. one suitcase which should not exceed 90cm x 75cm and one piece of hand luggage 56cm x 45cm.

6.2 Iksam reserves the right to advise if the vehicle type booked cannot accommodate specified baggage allowance. In these cases, you may be required to upgrade your vehicle type.

6.3 If a passenger requires carriage of baggage in excess of this allowance or has special baggage objects (e.g. skis, golf clubs, bicycles, snowboards, wheelchairs/scooters etc.) you must inform us by completing the special requests section of the booking completion form on our website.

  1. Amendments and cancellation by you

7.1 Booking amendments should be made no later than 24 hours before the transfer.

7.2 If there is a price increase caused by any change you request to the services that you have booked, you will be required to pay the difference in the price between the services originally booked by you, and the price of the new services you have requested.

7.3 If you cancel your reservation no later than 24 hours before the start of the transfer, Iksam guarantees a refund under the conditions:

(i) when paying in cash – full refund

(ii) when paying online – full refund excluding bank transfer fees

  1. Our responsibilities

8.1 If your arrival time changes iksam automatically changes the transfer time without any added fees.

8.2 Iksam and his partners guarantee the fulfilment of the transfer according to all legal norm.

8.3 If the transportation vehicle fails to operate during the service, Iksam or its partners shall repair or replace it as soon as possible, but shall bear no responsibility and shall pay no compensation to the Customer for any losses suffered (for example: missed flight, train, bus), due to delay in the service.

8.4 If the transfer is canceled due to Iksam failure to appear, Iksam shall refund all funds paid in advance, but shall bear no responsibility and shall pay no compensation to the Customer for losses suffered (for example: missed flight, train, bus), if Iksam fails to provide the service on time, due to circumstances beyond its control (for example: traffic jams, traffic accidents, road construction, etc).

  1. Responsibilities of the Customer

9.1 It is the Lead Party’s (or the agent, or any other person acting on behalf of the passengers whose names appear on the booking) responsibility to check all of the details of the booking prior to travel and inform Iksam as soon as possible if there are any errors. Iksam, its suppliers or agents cannot be held responsible or liable for timeliness, accuracy or quality of the services due to incorrect information provided at the time you confirm the booking.

9.2 To use the car for its intended purpose and with a due diligence.

9.3 Passengers are not allowed to consume alcohol or to smoke in any of the vehicles used to provide the services.

  1. Complaints

10 If Iksam or its partners violate any points of this agreement, you can send us by email travel@iksam.com your complaint. Complaints must be submitted within 28 days of the date that you used the services.

  1. Final provisions

11.1 The original Bulgarian version of these General Terms and Conditions has been translated into other languages. The translated version is merely an office translation, which does not have a legal value. In the event of a dispute regarding the contents, application or interpretation of the General Terms and Conditions or in discrepancies between the Bulgarian and the translated version in each language, the Bulgarian text, which is crucial, shall apply.

11.2 Iksam can transfer full or partial rights and obligations derived from the rental agreement if necessary.

11.3 Any disputes between the parties related to these General Terms and Conditions shall be resolved in good faith and mutual understanding, and if this is not possible the dispute shall be referred to the Arbitration Court at the Bulgarian Chamber of Commerce. The applicable law for resolving disputes is the Bulgarian Law.

These General Terms and Conditions are effective as of 15.12.2018
